NY resident got a CA DUI. What now?

I am a current resident of NY, but I got a DUI in California earlier this year. It was a first offense, but I don't know how to meet the CA plea agreement while living in NY.

Asking anon since I have't plead yet...

I got a DUI with a BAC of .11. I hired an attorney in CA who has represented me in court and I am planing to plead to the court's offer. The terms of my plea are:

- 3 years court probation
- Fine of $1770
- First offender DUI program (my attorney is saying I need to do a 3 month program based on the CA plea)
- 2 days county work alternative program (community service)
- IID required for 5 months if I want to drive in California

When I called the NY DMV, they said that I would receive paperwork about suspending my license and DUI program once they got the information from the CA courts. My attorney suggested I find a comparable program in NY. My research showed that a first offense program in NY is the DDP, which is 7 weeks. However, it does not mention community service for a first offense. My question is how I can find a way to meet the CA plea agreement in NY? Thanks for any help!

Anyone been through something similar? I can't seem to find anyone to talk to who knows any answers, especially about the community service.

Why can't your attorney tell you what the conditions are of the community service? It should be spelled out in the plea agreement. (I've only ever helped out on one DUI case, and it was in Ohio, but the conditions were quite clearly spelled out.)

Contact your attorney. Your attorney should be able to contact the local court in NY about what sort of community service options are available to you. When you do get into a CS program, document everything so you can always prove you did the service. Good luck, dealing with the consequences of a DUI can be hard.

You're OK anon. I can see why you're left wondering, usually the judge tells you where to go or the court arranges it. Call or visit your local courthouse to find out where you can do the service. Make sure you're going through the court system so that your time is properly documented.

Not a lawyer, but I did do community service once.

On preview, yes, your attorney should be able to find that out but it might be less costly for you to do it yourself. It shouldn't be a big deal.

I don't know about the probation, but I've been able to take a class in one state, to satisfy a court agreement in another, also for a DUI. Call your lawyer or the court and ask them if they'd be satisfied if you completed a similar program in your state. Maybe take a different drinking course that covers the weeks your missing?
