Identify this fly and rid me of em

What kind of fly is this, where do they live and how can I clear my backyard of them?

Hard to tell from the picture, but at that size they may be phorid flies, which breed in drains and on rotting food. If they are, the best way to get rid of them is to find the source and clean it out.
