Getting our shit at LEAST in a diaper or something

OH HAY it's another prenatal question. Pursuant to getyourshittogether.org, I am trying to put those pesky ducks in a row before August. What kinds of documents, topics, etc. should we include in an estate plan et. al.? And what should we add (e.g. life insurance) to solidify things a bit more in case of Bad Things Happening? Do I need to produce original documents at hospital?

My same-sex partner and I have executed health care powers of attorney and related documents. Rather than bringing a bulky envelope with the original documents every time we travel, I'd like to scan and upload the documents so that, in an emergency, I can access them on my phone or via email and show/email them to the hospital staff. Is that likely to be a problem? Do hospitals require original documents or certified copies, with the raised seal and all that jazz? Or are digital/scanned copies sufficient? Has anyone been in a situation where they had to produce such documents in an emergency situation and photocopies were not honored?

Elderly mother's finances. Help.

I've written before about my elderly mom's dementia. This is less about her memory problems (and mine dealing with them) and more about a sticky financial situation she's in, thanks to my stepsister. You are not my lawyer, but legal advice would be welcome. Prepare for flurries, inside. [more inside]

Who should I consult, and in which state, for tax advice?

I am not sure whether to consult a CPA or a tax attorney for this. I currently live in Chicago. My brother lives in Louisiana. I am, separately, the trustee of a trust for him and his designated power of attorney. While in Louisiana, I sold his primary residence acting as his POA. I deposited the proceeds from the sale into the trust. No 1099 was issued for the home sale. Howwww do I report this to the IRS? [more inside]

How does Power of Attorney Work in New York?

Since I am a lawyer (though of course, not your lawyer, and not his lawyer), a family member asked if I could help him with some issues regarding a durable power of attorney (NY State). Unfortunately, I'm not a trusts & estates lawyer, so I need some direction as to what I should look at and consider in order to let him know whether he should consult a lawyer with that expertise. I know you're not my lawyer, and I'm not seeking your legal advice. [more inside]

First they take away my tuna fish...

California legal/medical/ethical question: In advance of my going to the hospital to give birth within the next few weeks, I decided to download and fill out California's standard Advance Health Care Directive form, i.e. a living will (and to have my husband fill his out too, as long as we were at it). However, Google informs me via multiple sources that this form, even if signed and notarized, is "not valid if pregnant". WTF? [more inside]
