My employer hired someone that has the same job as me. Same title, same responsibilities. This person has a couple years less experience then me. I also have a wider skill set (I was on the interview committee). This person is the same gender, same race, and about the same age. The employee was able to negotiate a substantially higher salary then I get (posted on public website). I find this insulting and unfair. But, every search I do on unequal pay seems to only address discrimination. Do I have any legal grounds to pressure my employer into paying me the same or more than the new hire?

So my annual review will be coming up in a few months. My job title is "Software Support Engineer." I'm making something in the 30-40k range, which is a good amount for someone with as little experience as I've got (I just started in IT about 2 years ago.) Prepping for my annual review, I bought one of those Salary.com employer salary survey reports. Median pay listed for a "Software Support Engineer I" is $63k! Relating to yesterday's credit check question, how do you reply to a prospective employer who wants your salary history in a way that's fair to your value? So many IT/Web type jobs over the past few years have seen pay rates chopped down. If they ask, and A) I know my former employers don't give out salary information; and B) they don't require some sort of three year old pay stub - then why can't I just fluff it up to my true value again? I don't want to get in trouble, but I'm sick of getting low-balled. There's no way I can let them continue to get away with this! Do you just lie? What's the system?
