Estate-filter: How to cash a check made out to a long-inactive non-probate estate?

Misterben, my husband, is the sole beneficiary of the estate of his late grandmother, who died over twelve years ago. Last month, it came to light that his grandmother had a life insurance policy, and the insurer sent a check to Misterben's cousin D (his grandmother's niece, and the executor of the estate). Cousin D was unable to cash the check because it was made out in the name of the grandmother's estate. Neither the cousin nor Mr B have a copy of the will to prove that D is in fact the executor, since it was so long ago. The estate was too small to have gone into probate court, and neither Mr B nor cousin D remember the name of the lawyer who handled it. What can Mr B and/or his cousin do that would enable them to get the check cashed? The estate was in Florida, D lives in South Carolina, and Mr B lives in Washington state. There are no personal issues between Mr B and his cousin, and the cousin is happy to pass along the money once she can cash the check. It is a not huge but not insignificant amount, so he does not want to let it go.

Co-Founder Insists On Employment Contract

There are three of us who are starting a business next year and one of my future co-founders is insisting that everyone signs an employment contract stipulating that we stay at the company for at least three years. Contract violations haven't been discussed yet - the contract hasn't been written yet - but a hefty fine is likely. Is this type of contract common between co-founders? What other risks should I be aware of before/if signing this? [more inside]

Legal thoughts for use of clips in a homeschool movie

My 7 year old son and I have been working to make a movie out of a story that he wrote this summer for a homeschool project. In making the movie, since we do not have an effects department, we found a few short clips (a few seconds or so) from movies - which we own copies of if that makes a difference - that we would like to use. Since this is a project for school, we want to make sure that we follow all rules and complexity of doing something like this and wanted to try to get permission to use the clips. [more inside]

Legal Writing and Advocacy

Hi , I was wondering if any mefiers could help advise me on potentially choosing a certain module for my llb (undergraduate law) option. I was thinking of choosing the legal writing and advocacy option, but I am not sure. Has anyone any idea of what is usually expected in a module such as this? It strikes me as an option very similar that provided in American law schools. How are these usually assessed? The naive bone in me is entertaining the prospect of a slightly less harsh marking criteria compared to the substantive core modules I shall be studying as well; but I could be wrong. My course book mentions the break down of the module as follows: Legal Writing and Advocacy: - Reflective Learning Journal (40%) - Response to Consultation Document (30%) - Oral Presentation 1 - (15%) - Oral Presentation 2 - (15%) [more inside]
