Part of Our Tree Fell on Neighbor's Car - Who pays?

On Christmas Eve, a freak wind from the north knocked a large part of one of our cedar trees over. Part of the damage involved our neighbor's car, which was parked in her driveway. I am told that her automobile insurance is the legal payer, and, since the trees were healthy (although big), we have no legal obligation to her. [more inside]

Rear-end collision (3 cars, second driver fled), am I screwed?

Hi MeFi, I was on the receiving end of a car accident which occurred last week during rush-hour. I was traveling home from work on a very busy Charlestown Ave when I got had another car smash into mine. I had a bad case of whiplash and went sorta blank for a second but after I came out of the car I noticed a busted BMW behind with a driver still sitting there. The girl from the second car fled the scene. My suspicion was that she didn't have a license or didn't own the car or both. So in short, BMW (Car A) > smashes into grey vehicle with (Car B) which in turn smashes into me (Car C). My insurance adjustor is saying this is a complicated case because of how 'many impacts' I felt or heard. What the hell does this even mean? It felt like someone hit me with a hammer. He said the first party which caused the scene hasn't yet accepted responsibility and they have 30 days to do it or not. I'm sorta left broken and had two trips to ER and two MRIs taken which showed I have an upper disc injury in neck and shoulders. The back side of my car is completely damaged with me being unable to shut my trunk. It is still drivable but it looks like hell. I don't want to dish out $500 for a rental since I'm already drowning in bills. Insurance is telling me that I can't get reimbursed for the rental until someone accepts responsibility. Is this how it usually goes with insurance companies in USA? I'm flabbergasted. Should I get an attorney?

How to handle a double refund

I made a major appliance purchase at a major brick-and-mortar retailer via the web earlier this month. When the items were delivered they didn't fit and had to be returned. The items came in a set and, checking my credit card, it appears that, while they initialy charged my for the set, when they refunded me they refunded both for the individual items and the set. Obviously I have to give them their money back (if not legally, then ethically: it's a couple thousand dollars), but I'm concerned about the right way to go about this to avoid getting double charged the other way and to minimize my own hassle. A friend (no, really!) will officially be divorced next Monday, and will then own 50% of a residential property in Bucks County, Pennsylvania. The property has one house (that's basically a teardown), currently occupied by their ex (with no intention of selling), and one barn. The rest is undeveloped property. Would it be smarter to let my driver's license lapse?

(Posting on behalf of a friend): I was convicted of a DUI in March 2014, and am trying to pick up the pieces. I need to pay for an SR-22 which is insurance on my license. If I do not pay for this insurance my license will lapse. The policy is less expensive if I also insure a vehicle but I will not need a car in the coming months and cannot afford the payments. I need help figuring out if it would be smarter to not pay for any insurance (letting my license lapse), to sell the car and use the profits to pay the SR-22, or to just keep the car (though I really do not want to). FML Today I received a notice of "Unauthorized Use of Copyrighted Image" regarding a 7 year old blog post on my tiny, personal, completely not-for-profit website that only about 5 people ever read (that I had incidentally purged just 2 months ago) from a probable copyright troll (Sanders Law, PLLC). What does a federal legal assistant do?

I recently applied for and am now actively being considered for a legal assistant/senior case technician position with the federal government (Social Security Administration). Is it legal for my landlord to do this?

My lease, like most, says that subleasing is not allowed without manager's consent. I came in on a sublease and later let the manager know I was planning on subleasing. She just declared she will not accept any subleasing any more. Does anyone know if this is legal for her to do this? It's breaking faith, but not breaking the literal contract. California driver contesting a speeding ticket in West Virginia

A person with a California driver's license gets a speeding ticket while driving through West Virginia. The speed alleged on the ticket was 15 miles over the posted limit. What would be the insurance consequences if the driver simply paid off the ticket without contesting it? How could the driver find out more information about whether s/he should contest the ticket, or plead guilty to a lower speed? In what state should the person be looking for a lawyer to best answer her/his questions? What should be this person's next step? Also, would the answers be different if the alleged speed was 10 (or 9, or 5, or whatever) miles over the posted limit?

Should I be this mad at the airport, and if so, what do I do?

Anonymous because I'm not sure if legal action is a possibility. After many times of travelling with his CPAP machine with absolutely no problem, my SO was not allowed to board with it this time at our local airport. (There was a death in his family and he was flying on short notice.) They insisted it needed an FAA approval stamp or at the very least a letter from the manufacturer. We found the relevant letter on our smartphone but the airline employee (the one who was holding the machine hostage) insisted it had to be "on their letterhead." With only an hour before the flight took off, he had to go without it -for three nights. I called the TSA, and they were shocked. I called the relevant airline, and they put me on hold and then told me it was a local airport rule. I sent an email to the airport, and they claim it is an airline rule, and that I was misinformed, and that they were passing my email to the local rep of the airline. (after I responded.) Real Estate Law: Any Benefits To Us Getting Married Early?

YANL, YANML. I presently am on the deed to a house with a family member. We are joint tenants with full rights of survivorship. My family member holds the mortgage note entirely in his name. Other members of my family are becoming increasingly more aggressive in regards to me moving the mortgage into my name (which may not financially/credit wise be feasible).
