Possible Wage Overpayment--Five Years Ago

My girlfriend received a lawyergram stating that a former employer overpaid her nearly five years ago, and is just now asking for the money back. She believes she was never paid for that period, and obviously doesn't want to give them money to which they are not entitled. Details below. [more inside]

Cost of a New York City misdemeanor prosecution?

An activist performance artist is currently facing a year in jail for a 15 minute protest in a New York bank; the Manhattan District Attorney’s is charging him and his choir director with “riot in the second degree, menacing in the third degree, unlawful assembly, and two counts of disorderly conduct”. The case is well publicized and has first amendment issues; I’m curious about its economic implications. How much money will New York City spend bringing this case to trial? What if the trial goes past the one hearing? How much does it cost to jail someone for a year? Courtroom use; judge and prosecutor time; trials for other crimes having to start later, appeals: added up, what do these parts of a misdemeanor prosecution cost NYC in cash money?

Professional jobs that require night or shift work?

My parents have always worked night shifts as a nurse at a geriatric support centre, and as a mail sorter for the post office. They make enough money. They've made their schedules work for them, and also raised 4 kids while doing so. Because of their shift work, they do get a lot of time off-- maybe working double shifts sometimes, or three 12-hour shifts in a row, but then they get 3 days off. They also tend to know their schedules a month ahead of time. I do not work well in a 9-5 M-F schedule, so I'd like to know what are other similar jobs to this. [more inside]

Deciding to transition away from the legal profession-- too soon?

I'm a law student in Ontario, just about done 2 years out of 3. I absolutely hate the academic aspect of it, and I'm pretty miserable. I didn't particularly enjoy the practice experiences I've had either, at 3 different legal-aid type clinics working as a student in family law, criminal law, and landlord/tenant matters. I have invested a lot of money into pursuing this law degree. Should I be giving serious thought to finding something else to do with my life as soon as I graduate, or should I stick it out and work my hardest to try to get a paying job in the legal profession, in the hopes that I will be able to pay off my student loan debt? How am I supposed to repay a scholarship based on financial need?

How do I solve this? My kid can't go on a school trip that I never paid for; now they're saying I owe the school $3,000. One of my kids is a senior in high school and is active in a select chorus. The chorus director arranged a $3,000 trip to Europe for April break. I wasn't too excited about this trip and initially said no. Because my kids qualify for free lunch, the school said they would arrange a scholarship for her to attend, and based on peer pressure, I reluctantly agreed. [more inside]

Do we take legal actiona

Sticky Renting Situation Filter: I just moved into a house that my girlfriend and two other friends have been renting from my girlfriends mother for about 2 years now. Now my girlfriends uncles want to increase the rent (oral lease) pretty heavily and planned to do so before they even knew I was moving in. Do I use the law to protect our rights as tenants, or because it's my girlfriend's family do we just pick up and leave instead of fighting it? [more inside]

Does that make sense?

Debtfilter: Employer provides signing bonus structured as forgivable loan (forgiven if employee stays with firm long enough). Employee leaves soon after, and employer seeks to collect on loan. Employee is now a broke grad student, so employer offers to defer collection of loan until grad school is complete. Question: If length of time in grad school exceeds state statute of limitations on original loan, does this mean the loan will discharge itself before it can be collected? [more inside]

labor law in California

A good friend of mine works for a large international bank in the SF bay area. This person was informed today that beginning immediately, the two 15 minute breaks that have been allowed up until now are being reduced to 5 minute breaks. This person works a full 8-hour shift, and I was under the impression that a 1-hour lunch/meal break and 2x 15 minute breaks were required by law. What are the legal requirements in California, and how do they differ from federal requirements?
