Can auto claim be reopened?

After I settled an auto injury claim I found out the adjuster mislead me on a number of issues. Had I known that I would have obtained an attorney. Can settled injury claims get reopened (Adjuster says no)?

Car insurance in New Orleans

I bought a car!! It is a 1993 Honda Civic. I need to buy insurance. I will be driving my car about once a week, to buy groceries - otherwise I will be riding my bike around New Orleans, Louisiana. I don't know anything about car insurance. I am 34, have a perfect driving record. Can anyone help me figure out what kind of insurance I should get? I will be fine if the car is totaled or stolen and I cannot ever drive it again. I have health insurance for myself so I do not need to protect myself in that way.

I need help in just understanding the basic terms that insurance companies use, what I should look out for, and how much coverage I should get, and any other information that I'm not thinking of!

Thanks!

Insurance is good and I'd like to keep it.

Is filing too many claims always a death knell for your insurance? Our neigborhood has been going through a crime wave that is rather unprecented and ongoing. We've been broken into twice in the last three years and filed claims both times. The claim for both adds up to around $6,000. Great.

Then some schuck injured himself on a used tool he bought from us on Craiglist. Insurance company provided a lawyer who says "they have no case, surprised they had the balls to try and file this."

Yet, of course, we all still have to go through the requisite motions. We have been with this insurance company for home and auto for 10 years or so, but everything online I've read indicates that they are about to drop us like a hot potato. Do individual agents have the ability to protect us from whatever algorithm wants to dump us? Can we raise our deductibles, add some coverage something to get us some leverage?

Anyone have any experience with this? What did you do? What insurance company did you find to take your high risk butt?

Do I have to call back?

I found out new information about someone on my auto insurance. To avoid compromising a potential future claim, do I need to inform my insurance company? In the last month, I put someone else on my auto insurance (Geico) as a regular driver. The usual questions came up: have they been in any accidents, had any moving violations, and so on. I said I wasn't aware of any. Turns out that there have been. Do I need to let Geico know about this?

My concern is that if we had to make a major claim, failure to disclose this history might constitute grounds for Geico to refuse to pay out. Could that happen?

Can I / should I accept reimbursement for a car repair I didn't do?

Is it legal to accept $500 from a car insurance company, reimbursing me for a repair I'm not going to make? If it's legal, should I?

Recently my car was very lightly rear-ended. Both I and the other driver are insured. There were no injuries and my car has no visible damage -- I took it to my mechanic, who I trust, who confirmed that there was no damage from the collision. The other driver's insurance company sent a photographer to take photos of my car to check its condition. The photographer reported a small nick in my bumper, and based on this, the other driver's insurance sent me a check for $500 for a new bumper. The nick is almost invisible (my wife can see it, I haven't managed to) and we have no interest in getting a new bumper. My wife thinks it might be OK to just cash the check, on the grounds that the eventual resale value of the car will be lower because it's been involved in an accident, however small. I'm concerned that it might actually be against the law to cash a check for replacing a bumper that I didn't actually replace. I see a few options:
A. Cash the check, pocket the money.
B. Cash the check, replace the undamaged bumper. (Seems like a waste of the world's resources, but maybe I should think of it as economic stimulus?)
C. Don't cash the check, keep it, and if I need to replace the bumper for some other reason in the next year (the life of the check,) cash it.
D. Cut up the check.

We don't want to do anything illegal. So: which of these four options is legal? And of the legal ones, which are ethically OK?
(Anonymous in case the right answer is "A is probably legal but I wouldn't do it if my real name were attached to the general practice in a public place.")

Should I report my stolen car stereo to the insurance company?

My car stereo just got stolen - while my car was in my driveway. Should I report it to my insurance company? So I came outside not 10 minutes ago to find the passenger-side window of my '02 Chevy Prizm smashed in, and my 3-year-old mediocre Alpine head unit stolen. It was the cheapest one at the time that had an auxiliary in (I think $199 new, not that I have the receipt handy to prove it), and I was starting to look at replacing it anyway with one that had better iPod integration and HD radio, so I'm not particularly worried about the stereo cost itself - although it would be nice to have it replaced.

What I'm not sure about is - should I handle this out-of-pocket, or report it to State Farm to see what they'll do? While it would be great to have the repairs paid for, we have three other cars under our policy; I don't know if it works this way, but I'd be worried we'd be classified as a higher risk and have our rates raised. If any rates get raised, I'd rather just pay for it myself.

As a bit of background, we live in a mediocre to bad part of town - we haven't had any home theft lately, but did have a car stolen a few years ago that we reported and was eventually returned.

I don't yet have the insurance paperwork in front of me (going to dig those up next), but our plan with State Farm is fairly comprehensive... it's covered a windshield replacement due to a crack, and all of the rental/repair costs from when I was in a not-at-fault accident about six months ago and had some collision damage taken care of.

Side question - if I don't report it, is it even worth filing a police report? And am I allowed to drive it without the window for now (NYS)?

Thanks for any thoughts.

My truck is totaled. Now what?

Our SUV was probably totaled today. The police wrote the other party a ticket for running a red light, so blame shouldn't be an issue. Both airbags blew up front, which I think will likely total it without even factoring in the rest of the damage. However, I've never been involved with a totaled car situation, so I'm trying to get my act together to make sure I don't get screwed by the settlement. What do I need to know? I've got receipts for all the service ever done on the truck ( 2005 Durango Limited - 66K miles), and I've got a spreadsheet with all that data too. The truck was in very good condition both appearance wise and mechanically. I'm one of those people that actually keeps up with the fluid changes and other routine maintenance requirements. Kelly Blue Book online is telling me the trade in value is about $12,000 and the retail is about $16,500. The truck is paid off so I'm not worried about getting enough to pay off the loan. I'm worried about being able to pay cash for something comparable.

This is in VA if that matters.

I was in a minor accident, what do I do?

Do I need to report an accident to my insurance company within a certain time period to stay covered? I got into a small accident (my very first... whoopie :( ) that was completely my fault. I scratched the side of a parked tow truck with my passenger side mirror and messed up the lettering for the tow truck company (there's a long black streak over it). I exchanged info and he asked for a letter that took responsibility for the damage, to which I obliged.

We didn't file a police report or call insurance and he said he'd give me a call after he got an estimate for the damages. Then I could figure out if I wanted to pay out of pocket or through insurance.

He seemed like a nice guy but I don't want to get screwed. It's been about a day and my friend thinks if I don't report the accident to my insurance company soon, they could refuse to help me out if I eventually do.

So I'm starting to worry (I hope I'm just paranoid) about some kind of elaborate con where the tow truck's owner waits for a while and then calls me back and tells me I owe him 20k, or some ridiculous figure, only to find out that I'm out of luck because my insurance company doesn't give a hoot after some period of time.

So is there actually a time limit? What should I do? I'm living in California if that's relevant.

Benefits of bundling insurance?

What, if any, are the non-monetary benefits of bundling insurance policies (specifically auto and tenant)? I'm currently looking for tenant's insurance. I have auto insurance and know that premium discounts are the main reason to bundle policies with the same provider.

However, when shopping for new insurance, it seems that bundling insurance (auto+tenant) still works out to be about $7/ month more than purchasing policies from separate companies. Which isn't a lot... but $7 x 12 = $84/ year which starts sounding more significant (particularly on my pennypincher salary).

While the specifics of tenant insurance policies vary, let's assume that all the policies satisfy my coverage needs (with the more expensive policy actually providing more coverage than I need, specifically in terms of content value).

Additional details:
- Separate tenant insurance policy does not cover damage from backed up sewers.
- Separate tenant insurance policy has a $500 deductible.
- Bundled tenant insurance has $1000 deductible.

So Mefites, other than price, is there any advantage of bundling? Specifically, is sticking with one insurance company worth the extra $7 company/ month premium (especially given higher deductible)?

cheap auto liability insurance

Where can I get cheap auto liability insurance for an older vehicle? I want the minimum auto insurance required by law in PA, which is liability. We used to have Esurance, which I was happy with, but they seem to only cover cars made since 1981, and our new vehicle is a 1980. I know I can get quotes online, but I'm not sure where to start. Do you know a company with cheap rates that offers just liability coverage on a vehicle that old?

Old car crashed + next car purchased + insurance office closed for the weekend = magical amnesty?

Canadian Auto Insurance Question: Nebulous limbo time between vehicles edition.
"Everybody Knows" that there is a 14 day grace period to get your papers sorted out. Is there? The precise situation is that one vehicle has just been totalled by a young lady who had insurance under her father's policy [last car in a highway pileup; she says she's okay; she's going to the doctor just in case] and she is now setting up a new policy with the same insurance company for an 18-year-old used car she has just purchased.
Almost everyone that I've spoken to says that putting her old plates on this car and keeping the bill of sale with her will be okay for up to 2 weeks while insurance and registration are negotiated.

This doesn't match well with my impression of insurance companies.

I've already heard enough of "you'll be fine", and I've heard a couple of people say that it's crazy to go for a millisecond without documented everything, but I want to know what the law says.
Can anyone help me look this up?

I ask not because it's urgent right now [it isn't], but because it is the friday before a long weekend and if I *needed* an answer I know I couldn't ask the insurance company until tuesday.

To further complicate the issue, this vehicle has just had a safety inspection [vehicles over 15 years old need this inspection to be insured here] which identified worn brake pads + rotors. The parts have been ordered and I will have them replaced by tomorrow. Does the legality of things change based on this inspection if the vehicle is not insured either way?
And because this is the long weekend, the insurance currently on the vehicle won't be removed until tuesday anyway. Does that count for anything? Or against anything?

And if this mythic 14 day grace period doesn't exist, why is it such a popular answer?

Car accident/insurance advice

What should I do if I'm not sure someone's after the fact claim about a car accident is actually related to the accident? I recently rear-ended another vehicle in stop and go traffic during rush hour at less than 5mph. We pulled over, and looked at the cars. Both agreed no damage, but wanting to be a good doobie, I gave her my contact info in case something internal came up. I was foolish in that I didn't get her info, or even jot down her car's make/model or license plate number. I have a perfect driving record, and had never been involved in something like this, so it kind of took me by surprise and I wasn't sure what to do in the moment. No insurance information was exchanged and no police report was filed.

Several days later, she e-mailed to say that she had found damage, that she was away for the weekend but could send pics when she returned, and could I please send her my insurance information. I replied requesting that she send the photos, since we had both concluded there was no surface damage.

She subsequently sent two very dark photos of just the damaged area of a vehicle. I do recall that the other vehicle was a large SUV, and it's discernible in the photos that they depict a Ford Explorer. Here's the thing - the rear fender is knocked loose in the photos, and at a downward angle. I drive a small compact car that has absolutely no signs of any damage.

I showed the pics to a friend who works with cars and his take was that there was no way a collision at less than 5mph could have caused the damage in the photos, especially without sustaining serious damage to the front of my car. He also noted that based on the respective heights of the vehicles, her fender should have gone up and not down as the picture shows. Finally, he commented that the only way he could imagine the accident I described "causing" the damage was if it was already quite rusted (and there is some rust visible in the photos).

I found a Ford Explorer in a parking lot earlier this evening to just kind of compare heights, and what he says seems to be true. He suggested being back in touch with her and basically explaining the above, then seeing if she still wants to pursue.

What's the smartest thing for me to do at this point? Be back in touch with her? Call my insurance company? I'm kicking myself because I a) want to be responsible and take care of any damage that I caused, but b) just had a funny feeling when I got her e-mail and saw the pictures, which has only deepened since communicating with my friend. I don't want to be taken advantage of.

How do you negotiate with insurance companies after an accident?

How do we navigate auto insurance negotiation post accident? My partner was involved in a major auto accident this past week. We're now trying to figure out all the insurance craziness. Looks like all the other AskMeFi questions are dealing with someone else's insurance company and we're only dealing with hers. Any help you can offer is greatly appreciated.

On Monday she was driven off the road on I-91 near Holyoke MA. The other driver did not stop and no one has come forward with his/her license plate details, etc. There were witnesses and the police report indicates she was not at fault. She is lucky to be alive and is thanking her lucky stars that her 15 year old Audi took the bullet for her.

The car is totaled (we're pretty sure, as are all parties who have seen it thus far) and we're just waiting to hear from the insurance company. How can she best navigate this situation to get the most from her insurance company to replace the car?

The car was a 93 Audi 90s with about 108k miles on it. She was paying for full coverage. She maintained it well and had recently put in about $1600 worth of work into it.

We've been told that she can negotiate with the insurance company. We've also been told that they are likely to offer her considerably less than the NADA book value, but she should push back on them saying that's the guide to go by.

Is there an insurance adjuster in the house? Any tips, suggestions or insider information to make this as non-excruciating as possible?

Insurance claim against other driver denied. So what now?

Insurance claim against other driver denied. So what now? Two weeks ago my step daughter was involved in a collision. She was turning left at a four way stop, and was hit in the passenger side rear door by someone going straight on. She said she had let someone else through, then was taking her turn when he hit her.

The other driver said he was taking his turn, and she pulled in front of him. He also said that he was traveling at less than 5mph when he hit her. The police officer obviously didn't agree, asked him twice if he was sure of that, and suggested he look at our car before answering. One look at the damage made it obvious he was going a lot faster. (This is a fairly large intersection, so it is possible to build up speed, especially from a rolling stop).

He was ticketed, my step daughter was not.

Now his insurance company (Farmers) has denied our claim, saying he has a witness (who my stepdaughter never saw, and who did not talk to the police), who says that he had the right of way.

Our insurance company are now saying that they might pay his claim against her, and are no help for our claim as we had 3rd party insurance.

So now we have a written off car, a bill for towing and storage that is growing rapidly, and face future higher premiums.

So what do we do now?
Do I pay the $600 storage to get the lien off the car, sell it to a junkyard?
Sue Farmers?
Go to the other driver's court date?

(Oh, this is in Oregon)

I'm going without a car for half a year or so, what are my auto insurance options?

I junked my old car and am going without a car for half a year or so, what are my auto insurance options? My beloved car was recently totaled, and now I am going without a car for the time being (girlfriend and buses can suffice for a while). I figure that I can save on my expensive New York insurance and put that money towards a replacement car in the fall.

In light of this, it doesn't seem to make sense to have auto insurance for essentially nothing; what I'm unsure about is if it is a good idea to simply cancel my auto insurance. Will my rates be higher if I reapply to the same company (particularly in light of the totaled car)? Is there any way to suspend my auto insurance completely (but still sort of maintain ties to the insurance company)? If it is better to keep my insurance going, is there some sort of special insurance for people without an actual car?

(Side question: if I give up insurance but sometimes drive my girlfriend's insured car, is that a good idea/legal?)

How can I get enough money to replace my car?

How do I get a fair settlement for my totaled car in Pennsylvania? The insurance adjuster insists that I am not owed the replacement value of my car and refuses to budge. My neighbor hit a patch of black ice a few weeks ago and struck my unoccupied, parked 1996 Mazda Protege. A few days ago the insurance adjuster (Traveler's insurance) came back with a settlement of about $3300 based on the NADA book value.

I looked around and the Kelley Blue Book value for my car starts at about $3500 and goes up to $4300, with my low mileage car (~49,000 miles) in the upper range. Even cars with twice the miles are retailing at $4000. I've been collecting sales ads for replacement cars due to the good advice in this thread.

The adjuster refuses to budge and insists that I am only owed the NADA value of my car and nothing more in the State of Pennsylvania, even if a replacement vehicle would cost much more. They won't even consider retail prices for equivalent vehicles and were very short with me when I brought up the option.

My insurance (Geico) has been absolutely no help and has left me to take care of this on my own. I'm considering retaining legal counsel, but I don't know how to sort through all of the ambulance chasers. I'm not even sure if it will be worth it for less than $1000 difference.

I've contacted the state insurance bureau, but it will take them a few days to answer my question.

So, how does this work for Pennsylvania? Am I not entitled to the cost of a replacement car? Is the insurance adjuster even telling me the truth about PA law? They're taking the rental car back on Friday so I'd like to have a course of action planned by then.

Should I file a claim with my auto insurance?

Should I file an auto insurance claim on what appeared to be a fender bender but now involves engine overheating? The person I rear ended didn't see a need to claim since his car was fine so I don't have any info on him. So I ended up rear ending someone but they had no damage to their car but mine on the other hand, had section of its front bumper and hood crumple. He was all cool about it and said he didn't see a need to claim anything on his part, I looked at mine and thought only cosmetic damages, so we kind of just parted ways... The problem was later when I got back on the highway and my engine overheat light came on. Smoke was coming from under the hood, but because of the way the car was hit I was unable to open up the hood. I had to call AAA to get towed.

So now I'm without a car and trying to decide if I should make a claim to get it fixed or just go and buy a new car? I asked my friend who is more mechanically inclined who said I was looking at $3000-4000 in repairs.

My car is an 02 neon, has been paid off since 06 I've never had any claims before, clean driving record, turned 25 last month, my renewal is coming up next month, and my deductible is $1000. I don't know anything about the guy and he didn't get any information from me either. I have esurance.

My friend recommended to not mention the fact that I hit another guy and that I should instead just say I hit a stationary object. His reasoning that my chances of insurance going up due to damage not related to an accident is lower than saying I hit another car.

How long can I drive a car before turning it over to the insurance company?

Someone hit my car. Their insurance company wants to total it. How long can I drive it before they take it away? I hope you'll bear with me. This will take some explaining:

Here in Pennsylvania, my '97 Nissan Sentra was fender-bent by a nice person who left a note under my wipers. As an older vehicle, the Nissan's repair costs are higher than its value... by a little bit. I had the car checked and it's mechanically sound, safe, and even capable of passing an ordinary PA state inspection. However, the insurance company wants to declare it a total loss and take it off my hands.

I could buy it back from the insurance company after they pay me for it, but then the car would be considered a "reconstructed vehicle". Here in PA that means a special, expensive, rigorous inspection designed to keep hucksters from selling totaled lemons to grannies. Passing that one could be hard for any ten year old car, I gather.

On the phone with the insurance company I've noticed that the representatives have been, well, coy about putting a date on when I have to decide what to do with my vehicle. I've been warned that waiting too long and building up mileage on the car will lower its value and hence diminish the eventual insurance payout. Which brought the question:

Me: So, ah, hypothetically speaking, what happens if I drive it around for, say, two years and then make up my mind?

Rep: I don't like to deal in hypotheticals...

She went on to say that the claim would be closed and reopened, and then repeated her warning about the car's value dropping with more mileage. But she didn't fit a deadline. Does this mean that, basically, I can drive my car around until I was planning to get rid of it anyway, and assuming I don't have an accident, the insurance company is obliged to buy it when I'm done with it for what it would be worth without the big dent? Here are the questions I need help with:

First, see question above. Then, assuming the answer is yes,

Is it ethical? Some thoughts about who's involved: the insurance company would be paying me anyway---now they can hold onto the money longer and invest it, then pay me less money in the end. The company might also choose not to raise the rates of the at-fault party until the payment---good for the at-fault party now, but perhaps an unexpected surprise later on. I'm owed money for my loss, but if my plans haven't really changed, how much of a loss is it? (Trade-in value, I suppose...)

Is it legal? This I can't answer... perhaps there's a statute of limitations? But the claim is already filed... it's just on hold. (YANAL, I know...)

Dumb questions about car insurance

I've got a few questions about car insurance I have owned my car for about three years entirely on my own. My insurance premium (IMO) is quite high. In the past 3 years, I have paid my insurance company about half of what my car is worth and I am yet to make a single claim. I currently don't have a good driver discount (last speeding ticket was in 2005 and it won't come off till June 08) and my rates can't go lower (because I live in a really safe town with no crime and it can't get any less crime free).

My questions:

a) The insurance company is insuring my car for what it's worth, right? If so, my car has devalued quite a bit since I've had it. So technically, it would cost them a fraction of what I originally paid to replace the car (if I were to total it). Then doesn't it seem logical that they charge me less over time?

b) Is there a objective website that will give me some idea of what I should be expect to pay (ballpark) for a make and location?

I just don't have any frame of reference.

How can I safely shop for auto insurance?

How can I shop for auto insurance without compromising my privacy? I HATE telemarketing and junk mail, so I avoid giving my name, address and phone number to anyone that might possibly sell it. I am also very protective of my SSN. I'm ready to change auto insurance providers and would like to shop around for a decent rate, but the few companies I have called ask a lot of information that I'd rather not give unless I'm sure I'll actually be doing business with them.

Does anyone have advice of how I could get a general idea of who will have the best rate by giving only basic info? Like, maybe I provide my ZIP but not the exact street address or give them an approximate FICO score but not my SSN? Of course, once I have narrowed it down to a few companies, I won't mind giving them the details so they can give me a precise quote.

Highway robbery!

Auto insurance recommendations in Ontario for a new immigrant? I've just moved to Ontario and am trying to get auto insurance. However, due to the fact that I've just moved here I don't have my long history of safe driving -- my records only go back to 2004. Doing some random digging (PC Financial, mostly) results in insurance quotes of over two hundred dollars a month, which completely flabbergasts me. Do any kind Ontario folk know of some secret ways I can bring these payments down? Any providers you think are better than others? Is it possible to get some sort of incredibly high deductible or something to bring down the price? This is major ouch. Thanks much.

My name or his?

My husband was issued a few traffic tickets for expired insurance and registration. He wold like them dismissed. With a $300 price difference and not much cash, should the insurance be in my name or his? We recently brought an old vehicle into Texas for my husband to use for work. The vehicle has expired tags, registration, and insurance, and he has a suspended license in another state (unpaid traffic ticket). Last week he was written a few tickets for all three expirations. Yes yes, we knew it was coming.

Now we are working on getting the insurance taken care of first. We have a very tight budget so I thought the insurance should be in my name, as it is $300 less than what we would have to pay if it were in his name. The problem with this is the officer did not issue my husband a ticket for his suspended license, and he thinks that may bring up some problems when he goes in to take care of the tickets.

Basically I need to know if he has a chance of having the tickets dismissed if he is not on the insurance (the vehicle will have up to date insurance, tags and registration, and he will have an unsuspended license).

The Sound of Settling

How can I handle settling the costs of a minor auto accident without getting my insurance company involved? I lightly rear-ended another car at an intersection. There was no damage to my car, and a small crack in the bumper of the other car. The driver and I exchanged insurance information, and she agreed to get a quote for the repairs before filing an insurance claim, in case I wanted to pay cash for the repairs without involving the insurance company.

She faxed me a quote for the bumper repair, and for the amount involved, it's worth it to me to pay out-of-pocket to avoid an increase in my insurance premiums. I'd be happy to send her a check for the amount, but I'm wondering what kind of documentation I should obtain to make sure that my liability in this matter is settled?
