I can't pay my mortgage in January. My job was eliminated in July, and I'm currently working as a contractor for 70% of what I was making earlier in the year, and about 50% what I was making 18 months ago. [more inside]

An elderly friend has a home in san francisco that is about to be foreclosed on, she has exhausted all of her legal appeals and avenues to block the foreclosure and does not have any assets to bring the mortgage current, suggestions for ways to help her save the house or pull the difference in market value out of the house (my guess is ~ 4 - 600k in equity with some work put into the house)? What can be done with fraudulent attorney?

This is happening in California. I am helping a friend find his way through a legal morass. He hired an attorney who came highly recommended by two acquaintances. His attorney agreed to sue a mortgage bank for fraud, prevent foreclosure, make a new loan workout, and sue for other damages (incredible emotional distress). Unfortunately, the attorney has completely flaked; committed multiple no-shows (fined four times by the judge and referred by judge to State Bar for sanction); and my friend's case was actually dismissed by the judge for the last no-show, only to be reversed by the judge because my friend accidentally happened to be in court that day to watch his proceeding, and pleaded for a continuance. The judge in this case even suggested my friend get another attorney, as she (the judge) reversed the dismissal. [more inside]

My mother in law was placed permanently in a nursing home last year. It took about 14 months, but her home has finally gone into foreclosure. This is fine with us. We were served with the papers on her behalf last night, and I noticed that there were additional defendants besides her listed on the form. Is a property lease considered an asset in a UCC-1 financing statement? I recently sold my small business and am carrying a note for the buyer. His collateral: the assets of the business he bought from me. If the buyer defaults I will want to take possession of the assets, per the UCC-1. The foreclosure process is straight forward, but I do not know if the new lease he signed with my old landlord is considered an asset by the UCC-1. If it isn't, how can I retrieve my assets if he still "owns" the lease?
