My wife and I have been working and saving over the last 4-5 years. We've managed to pay off all of our debts and have gotten ahead. It feels great to be debt free, but we want to buy a house. Should I walk away from this mortgage?

Non-performing Residential Loans

Has anyone figured out how to approach a bank to purchase non-performing residential loans? I've approached a local bank. Although it would probably be in their interest to sell the loans, they don't seem to have a mechanism. I haven't figured out how to crack this nut.

Where does the foreclosure auction when the title transfers from the owner to the bank actually occur and how do I get information about these auctions. I live in NM, but foreclosure auction practices in other states will probably help me figure this out. Why does this foreclosure auction seems so odd?

Our house was recently sold at auction due to foreclosure. I'm curious about the details of the sale, specifically the fact that the same bank that owned the mortgage won the auction (bought the house from themselves?) and also that they paid way more than the house is worth. [more inside]

What can be done with fraudulent attorney?

This is happening in California. I am helping a friend find his way through a legal morass. He hired an attorney who came highly recommended by two acquaintances. His attorney agreed to sue a mortgage bank for fraud, prevent foreclosure, make a new loan workout, and sue for other damages (incredible emotional distress). Unfortunately, the attorney has completely flaked; committed multiple no-shows (fined four times by the judge and referred by judge to State Bar for sanction); and my friend's case was actually dismissed by the judge for the last no-show, only to be reversed by the judge because my friend accidentally happened to be in court that day to watch his proceeding, and pleaded for a continuance. The judge in this case even suggested my friend get another attorney, as she (the judge) reversed the dismissal. [more inside]

Extra people listed on a foreclosure action

My mother in law was placed permanently in a nursing home last year. It took about 14 months, but her home has finally gone into foreclosure. This is fine with us. We were served with the papers on her behalf last night, and I noticed that there were additional defendants besides her listed on the form. Is a lease to a property considered an asset?

Is a property lease considered an asset in a UCC-1 financing statement? I recently sold my small business and am carrying a note for the buyer. His collateral: the assets of the business he bought from me. If the buyer defaults I will want to take possession of the assets, per the UCC-1. The foreclosure process is straight forward, but I do not know if the new lease he signed with my old landlord is considered an asset by the UCC-1. If it isn't, how can I retrieve my assets if he still "owns" the lease?
