Drug-testing filter: A friend of mine is working for a non-profit domestic (USA) organization and was asked to get a DOT health/medical card to drive a truck/trailer combination in excess of 10,000 lbs, carrying heavy equipment. Will a drug test be required?

I just had an offer for my absolute dream job at a large British bank in New York rescinded 2 days before I was to show up for work. I had signed all forms and passed the background check, but I came up as positive on the (
gc-ms urine) drug test for - of all things -
benzodiazepines. I have never taken a benzodiazepine and am posting anonymously so you know I have zero reason to lie.

I expect to fail the pre-employment drug test I took this afternoon - but for legitimate reasons. I'm leaving the state tomorrow morning and won't be back until very late Sunday. Is there anything I can do to bolster my case and protect myself when the lab calls tomorrow or Friday?

HR/YANML filter: One of my assistants had an on-the-job injury today, and at the hosptial, they failed to give her the pee test drug screening that our company requires. She's concerned that they may use that as basis for claiming that she refused the test, and therefore will be on her own for the expense. I don't feel like this is the case, but I wanted someone with a more informed answer to help me reassure her.
So, do they have the burden of proof if they claim she refused? How long after the event can they require it?

I have a friend (shh) who failed to show up at court for driving on suspended permit. She's never gotten this taken care of because she's stupid, and 8 years have passed. She now lives in a new state, attends college, is really nice (despite being stupid) and is about to get a corporate position that involves drug test + background check. Advice needed. [MI]
