How would you interpret Right of First Refusal in this circumstance

Between two parents sharing 50/50 custody, their MSA states: "If either party is unable to care for the minor child during their designated time, they shall each give the other the first right of refusal in caring for the minor child." Given that language, if the custodial parent sends someone else to pick up the child afterschool just to bring the child back to same parent, can the non-custodial parent invoke right of first refusal and insist that s/he be the one to do pick up and drop off of the child? I understand that ROFR exists to maximize the time a child can spend with a non-custodial parent and help maintain consistent contact of the child with the both parents. Just wondering if it applies to such a short period of time (5 minutes to/from school).

My ex hasn't seen our kids in years. He has called about three times total in 2014. He did miss birthdays and Christmas though. Youngest son doesn't know who his dad is. Oldest son wants nothing to do with dad. Ex owes over 10k child support. He recently started paying child support again. He has expressed interest in having the kids over the summer. My ex has suddenly decided he wants to parent again. He got a bit screwed when it came to holidays and summer because based on his behavior during our marriage and the divorce he wouldn't be bothered. Anyways he says he has a lawyer and is going to send me papers to sign to lower his monthly child support payment and adjust holiday visits because he is making less money than when we got divorced. How do other people handle extracurriculars and visitation?

Hello, everyone. My daughter visits with her dad every other weekend. We do not share any level of custody, she lives with me most of the time. He lives about 30 minutes away from our town. My daughter is 9 and really needs to be able to join clubs and sports teams and take classes. Her dad has so far refused to take her to the scheduled classes and meetings that fall on his day (with a few exceptions, but his agreement did not come easily...). We don't communicate well at all, it's a long story. My daughter now has an opportunity to take a great class with a great instructor and of course the classes fall partly on his days. [more inside]
