What is it like to file Chapter 7 bankruptcy?

I am looking at filing Chapter 7 bankruptcy in the next month. I would like to know what this process is like and how nerve-wracking it is and how anxious I, an anxious person, can expect to be throughout. You are not my bankruptcy lawyer, nor are you in my situation with my specifics, but I would like to hear about your experiences. More about my personal situation under the cut so you can give advice if you feel so inclined. [more inside]

What can be done to make Chapter 13 less horrible for a human creditor?

We are not a bank, but hold a secured note. (Complex details inside) Days before the sale, the debtor just filed Chapter 13 bankruptcy. What can we do to maximize our chances of getting either the property or the loan/lawyer fee amount soon? We were counting on this for a lot. Also, please help me not get taken for a ride by a lawyer that I'm not sure is acting in our best interest, and not panic. [more inside]

Two Money Questions re: the Thiel/Gawker Situation

1. Any speculation as to whether Peter Thiel would share in (or entirely commandeer) Hulk Hogan's award from the litigation Thiel paid for? If so, how would this have been locked in (given that the check will surely be cut in Hogan's name)? Via private contract at the time Thiel started paying, or via handshake, or...? 2. Will Nick Denton likely make anything at all from the Univision sale? Or would this probably be a total wash for him, personally?

Should I preemptively tell a new employer about a recent bankruptcy?

I'm hoping to start a new job soon and the company has extended an offer which I have accepted. However the offer is contingent on the results of a background check which I understand is either in progress or will be performed shortly. The problem is that this background check will show that I filed for a Chapter 7 bankruptcy early this year and received a discharge shortly thereafter. So while I wish I could take this moment to celebrate a great new opportunity, I'm afraid that the offer might be rescinded at any moment due to this new information. [more inside]

Minnesota bankruptcy

I am thinking of filing for bankruptcy - Chapter 7, as I am unemployed since February and have no assets. I have $0 in my bank account due to a levy by the Minnesota Dept of Revenue for 2013 taxes. (I have since talked to them and am in the process of getting that straightened out.) I have zero money, and if it weren't for the generosity of a good friend would be homeless. Are there any pro bono services in Minneapolis that can help me, or would filing myself (probably) be okay, as long as I follow the filing directions carefully (the MN bankruptcy court site has a pretty good page on what forms need to be filed, etc)? I don't have $1200+ to pay a regular attorney. Any advice appreciated. I'm completely overwhelmed and now afraid that any future job opportunities may be threatened due to the potential for garnishments, etc.

How can I protect inheritance money in a bankruptcy situation

Our business is not doing as well as we hoped and we're considering closing it. The problem is that we're in a 5 year lease and have 4 years left. I confirmed with our lawyer that despite our business being an LLC, we are personally guaranteeing this lease. From what I understand, the only way to get out of a business lease like this is to declare personal bankruptcy. The only asset we have (besides the equipment, etc in the business) is a small inheritance. I don't want to lose that. [more inside]

Is Sr. Citizen Bankruptcy a Good "Why Not" Idea?

My mother is 80 years old and has good credit but wonders if she'll ever use it (or even if anyone would allow her a major purchase that would require a loan/credit, considering her age/income/lack of any savings or assets, which seems unlikely from her experience). Her income is (not much) fixed social security and could qualify her for bankruptcy. She could wipe out $200/month of credit card payments with a BK without affecting her house (she co-owns with a sis), and she could keep (not declare) a credit card for emergencies. Are there possible downsides to BK? Or is it a clear-cut case of more income for her senior years? [more inside]

Applying for a credit card with bank I stiffed 20 years ago.

So when I was in college I ran up a $700 credit card debt with Citibank visa. Then I didn't pay it. And for over a decade my credit was crap. But eventually I turned it around and have good credit again. So here's my question: I need to get a credit card for one of the biggest hotel chains as I stay there for business a bit. I'd like the benefits and points maximizing. Problem: the best card is run through citibank. Since my teenage folly I've changed my name but I still have the same SS#. Will applying today reactivate the debt with them?

Can loan security be conditional on bankruptcy or death?

Is it possible to write a loan contract which effectively secures the debt against the borrower's property only in the event of bankruptcy or death of the borrower? I.e., as long as the borrower is in control of his financial affairs the lender has no right to the secured assets even if the borrower defaults, but if the borrower dies or goes bankrupt the security kicks in, so that the debt has priority for any third-party trustees managing the estate? Will my credit score improve 2 years after my chapter 7 bankruptcy?

My wife and I declared bankruptcy 22 months ago. It was the only way, and we have no regrets whatsoever. We managed to keep our house and what little equity we had. We are looking to move to a different house, and are curious about our mortgage options. My credit score today was 681, which is just on the edge of where (so I read) you can get a conventional mortgage. In two months, when we get past the two year mark on our bankruptcy, will the score go up appreciably, or is it a gradual thing? [more inside]

I bought a business a few years ago, and now it's making me completely miserable.

I own an Apple reseller somewhere in the United States. I bought this company from the former owner a few years back, despite having no education in business whatsoever (other than what I've learned on the job.) When I first took over as owner, it was kind of fun, challenging, a lot of work, and just slightly profitable (though with a debt from the loan I took out to buy the business). It was like this for about a year. Since then, not so much. Most days, I feel trapped and hopeless. So now I seek ideas. [more inside]

Need Help Facing Daunting Subject of Bankruptcy

I am seriously considering declaring bankrupcy. I have a few main questions: 1) Do I need to know each company I owe money to? My parents opened all kind of credit cards in my name years ago, and I don't know about the specifics, and would like to avoid speaking to them as they are not exactly trustworhty. 2) How do I actually start the process? Who specifically do I see to manage declaring bankruptcy, considering I have zero cash? 3) If I have a credit card in my name, for which my partner is the main holder, will I have to cancel my part of that card, which I hold only for emergencies?
