Is New York City's Tar Beach still a thing?

The door to the roof of my new NYC apartment beckons to me with dreams of sunset glasses of wine and weekend lunch picnics, but am I inviting trouble? Does "unofficial rooftop access" exist? I know people in the city hang out on their roofs all the time, but exactly how kosher is this? And what is the limit? Do landlords on average just turn a blind eye? Details inside. [more inside]

Is it legal for my landlord to do this?

My lease, like most, says that subleasing is not allowed without manager's consent. I came in on a sublease and later let the manager know I was planning on subleasing. She just declared she will not accept any subleasing any more. Does anyone know if this is legal for her to do this? It's breaking faith, but not breaking the literal contract. FYI, I live in Missouri.

Can I somehow piggy back on my roommates rights to break the lease as of the Service members Civil Relief Act (SCRA)?

One of my roommates is in the military, he just got noticed that he is going to be redeployed in May/June. Our other roommate recently moved out and we are subletting her room for her. The lease doesn't technically end until October 2010, but I would prefer to go earlier. Roommate he-said she-said results in us being short a quarter of the rent. Help!

My roommate wants me to find someone to take her part of the rent, arguing that the people who took over my part of the rent really took over her part. She is threatening to simply not pay. We have one month (Nov) left on the lease. Her name, as well as mine and two other roommates' are on the lease. If she went ahead and didn't pay, how badly would this affect my credit? [more inside]

How do I pick the right tenants to sublet (or swap for) my apartment, and how do I help them feel at home?

Have you done a short-term sublet (or housing swap)? If you were the renter: how did you evaluate applicants, and how did you help your subletter feel at home? If you were the subletter: what worked, and what do you wish the renter had done for you or told you?
