Do I Call The Cops, And Where Are We Towing This Thing?

AutoAccident101: a) Do you always call the police? Surely if you don't the other party could later deny involvement. b) If your car is undriveable, when the tow truck turns up and they ask you, "where would you like it towed to?", where the hell do you get it towed to? [more inside]

Ok, well, it turns out Dollar Rent A Car wants to take me to court for the $1000. (see: this question) I plan to file in small claims court before they can take me to court because I think that will give me a better chance of winning. Should I take the unlicensed driver who destroyed my car to Chicago small claims court?

My car was just totaled by an unlicensed, uninsured 16-year-old driver in Chicago. I'm insured, but I have no collision coverage, so any/all expenses are strictly out-of-pocket. So I was crossing the street right after work in the crosswalk, on a green walk sign. A cab was making a left turn, ran into me, knocked me down, and then ran over my foot! The worst part was that he stopped ON TOP OF MY FOOT, wth?! A few weeks ago while playfully wrestling around at a family gathering, I was basically tackled and a knee landed on my arm, pinning it to the ground.
