My car was just totaled by an unlicensed, uninsured 16-year-old driver in Chicago. I'm insured, but I have no collision coverage, so any/all expenses are strictly out-of-pocket. The teen responsible was found to be 100% liable on the police report. Can/should I take the family to small claims court? I was rear-ended pretty hard by a drunk driver while I was driving. I will have medical bills that are pretty high, and my neck will probably be messed up for months (at least). Will the insurance companies pick this up sufficiently, or should I seek legal counsel, who wants 1/3 of the recovery? This happened in Kansas. Any advice on getting diminished payment value for vehicle after collision? Their insurance company said that there was no diminished value after our car was rear ended by a semi-truck. [more inside]
