Oregon 51% Bar Rule - If I am 50% at fault, why can't I collect?

I was found 50% at fault for a recent vehicle sideswipe. My insurance company is stating they did me a favor in awarding me this percentage, as it was a he said-she said situation where no one could be proven completely at fault. I do not have collision coverage, so I don't expect payment from that. However, when I asked about receiving payment for damages to my car from the other drivers liability coverage, I was told that I would not receive anything due to Oregon's modified comparative negligence law. Not-My-Fault Accident. Other driver wants to settle without insurance

Yesterday I was rear ended by a young woman driving a scooter. She apologized and admitted fault. I took her contact information and insurance information, but did not file a police report. I thought the proper thing to do was to call my insurer, tell them what happened, and give them the other driver's insurance information, and I did so. (Asking for a family member). They were rear-ended in someone else's car, as a passenger, in February. The insurance of the driver of the car she was in has told them that claims (for physio etc) need to go through their soon-to-be-ex-spouse's insurance--they separated in September. My family member said that the insurance adjuster used a specific word they can't remember, but that essentially as a married (on paper) person, the spouse's insurance takes precedence. [more inside]

The other driver and his insurer (State Farm) have accepted full responsibility without question, as I was stopped and he hit me. There was no police report. Got in a car accident last night (in Philadelphia... a block from my house). (Both drivers alone and ok.) Haven't gotten the final adjuster report yet but it looks like it's going to come back mostly my fault (no matter how much I disagree). The car was towed to someplace really annoying to get to because I was suggestible to vulture tow truck operator. Sort of witness to terrible car accident

I was waiting at a light this weekend, and there was a terrible accident between two cars coming from opposite directions in the intersection. It all happened so fast, and there were already people running towards the car that got the brunt of the accident, and a person on the phone calling 911. I learned later that there were actually fatalities, which didn't surprise me because I got a look at the one car, and it was so bad. My question is: the police are asking for anyone who may have witnessed the accident to contact them to give a statement. I, unfortunately, don't seem to even know if I actually saw the moment of impact or not. It's very odd, and I keep wracking my brain trying to remember everything that I saw. Should I come forward, or will I just be a useless witness?

Rear-end collision (3 cars, second driver fled), am I screwed?

Hi MeFi, I was on the receiving end of a car accident which occurred last week during rush-hour. I was traveling home from work on a very busy Charlestown Ave when I got had another car smash into mine. I had a bad case of whiplash and went sorta blank for a second but after I came out of the car I noticed a busted BMW behind with a driver still sitting there. The girl from the second car fled the scene. My suspicion was that she didn't have a license or didn't own the car or both. So in short, BMW (Car A) > smashes into grey vehicle with (Car B) which in turn smashes into me (Car C). My insurance adjustor is saying this is a complicated case because of how 'many impacts' I felt or heard. What the hell does this even mean? It felt like someone hit me with a hammer. He said the first party which caused the scene hasn't yet accepted responsibility and they have 30 days to do it or not. I'm sorta left broken and had two trips to ER and two MRIs taken which showed I have an upper disc injury in neck and shoulders. The back side of my car is completely damaged with me being unable to shut my trunk. It is still drivable but it looks like hell. I don't want to dish out $500 for a rental since I'm already drowning in bills. Insurance is telling me that I can't get reimbursed for the rental until someone accepts responsibility. Is this how it usually goes with insurance companies in USA? I'm flabbergasted. Should I get an attorney?

Major (ugh) car accident. Will my car be safe to drive after repair?

My 2012 Prius's driver-side front corner hit the passenger-side rear corner of the car in front of me. Thankfully, everyone was fine, sans my bruises and bumps. The insurance adjuster says the car can be fixed. The repairs are over $10,000, and most are unsurprising. But the estimate says they also need to replace the suspension crossmember and the left axle assembly. I don't see anything else on the estimate about frame damage. I drive a lot. Car accident last night: Can I still drive this car?

I was in a rather scary car accident last night. I was on a two lane interstate highway with a lot of volume. I was in the right lane next to an 18 wheeler in the left lane. The front of my car was just ahead of the front of the truck. He evidently tried to change lanes into me. I saw nothing. The truck hit my back drivers side door causing my car to spin out of control. I did a few 360's on the interstate before smashing into the guard rail on the left side of the fast lane. Luckily, there was a gap in the guard rail that my car found and I spiraled into the brush in the median strip, opened the door, and walked away. The trooper said I was a very lucky man. Nobody else hit me during my spins! And when I asked if I could drive home, he emphatically said no way. So I had it towed....100 miles.....$525. Anyway, the car now sits in my garage. All the damage was in the rear, and brake lights and directionals still work...amazingly. Do you think it is OK to drive this car for a few days before the adjuster looks at it and I get it to a shop? That piece of car that juts out behind the back wheel has me worried.
