Please help me with my quest for getting a refund on my dodgy car

Details inside (of my issues with this dodgy trade dealer).

(in the UK) So I purchased a car and after having it for 3 days, drove it and it shuddered to the point where it broke down after 20 miles. The trade dealer I bought it from collected the car and said the problem was the fuel injectors, which he then repaired. I then drove the car and it seemed all right for a few weeks. The shuddering then started to return so much that I don't feel it's safe to drive.

I've had the car now for longer than one month, but less than 3 months, so by my research, I should be able to get a full refund as the dealer has attempted to repair the issue once and failed. Firstly, I sent him an email, which he never responded to, so I then sent him a letter (via recorded delivery) requesting (under the consumer rights act) that for the above reasons, I would like to request a full refund, but he has sent me a letter back not rejecting my request, but avoiding it by saying he is 'concerned' that I haven't phoned him to inform him of the issue re-occurring.

Our relationship has already gone pear shaped, so reasoning with this man is not an option. I don't know whether I need to write another letter or seek legal help (the car isn't worth that much, but I don't have much money either) or whether I should start filling out the forms to take him to the small claims court.

Does anyone have any advice or know of someone that has had this same problem?

I believe in the US they have to fail to repair the same thing 3 times in order for the Lemon Law to take effect, but I don't know what the UK's version might be. That said, you can tell the dealer (by registered mail) you prefer to communicate by mail to preserve a paper trail. That should put your intent squarely on his radar.

You should make an appointment at Citizens Advice.
