Vitaly Borker, Decor My Eyes Jail Sentence

Perhaps a waste of question, but I am having trouble finding out: whatever happened to Vitaly Borker, of DecorMyEyes infamy?

I last read that he was scheduled to be sentenced in late September 2011, but I was curious to know what the resolution was? It appears as though he was facing jail time, but I can't find details on what the final sentence was. I see the site is still up & running, and wondered who is behind it now.

Best answer: I checked Pacer, and the sentencing has been rescheduled a number of times, including because Borker requested a Fatico hearing. A Fatico hearing is designed to allow a judge to determine whether allegations in a Government sentencing memorandum that are disputed by the defense should be considered in deciding punishment. That hearing was held in early March, and both Borker and the government submitted additional sentencing memoranda after the hearing. Sentencing is currently scheduled for May 10.

I didn't look at the file in to much detail, but it's possible that the conditions of his bail allow Borker to keep running his business, at least pre-sentencing.
