Can a radio service such as XM or Sirius replace the need to pay ASCAP/BMI fees for a business waiting room?

Simply put, does the use of a pay service like XM or sirius relieve a business of their ASCAP/BMI obligation? I am told that Muzak, specifically does alleviate the fees as they are 'rolled in' to the service model.

You'll have to use their commercial service, XM for Business. From their FAQ:

Are commercial music rights fees paid by XM?
PlayNetwork pays all required fees to ASCAP, BMI, SESAC, etc. There are no additional fees you are required to pay unless you operate an establishment that charges an admission or membership fee (e.g. a theme park, skating rink, dance club, health club, etc.) or use music sources other than XM (e.g. CDs, DJs, live music or terrestrial radio, etc.), in which case you are responsible for payment of any copyright royalties to ASCAP, BMI, SESAC or for any sound recordings.

There's also Sirius for Business. The fact that they handle the rights are what's special about Muzak and these services, not just the simple fact that you pay for it.

Just to clarify in case anyone is confused: the regular consumer versions of XM and Sirius are only licensed for personal private use. The business versions must be used in a business or public setting.
